Legislation introduced in Congress to allow permanent, year-round sale of E15 fuel

Bipartisan legislation recently reintroduced in the U.S. Senate would allow the permanent year-round sale of E15, regular gasoline mixed with 15 percent ethanol.

“It’s time to once and for all solidify President Trump’s pledge to allow the sale of year-round E15 — giving America’s producers and consumers the certainty they deserve,” said U.S. Sen. Deb Fischer (R-NE), a Senate Agriculture Committee member who reintroduced the Nationwide Consumer and Fuel Retailer Choice Act of 2025 on Feb. 13.

“My bill will put an end to years of patchwork regulations and finally make nationwide, year-round E15 a reality,” she said.

The bill has the support of numerous industry groups including the American Petroleum Institute, Growth Energy, the National Association of Convenience Stores, the National Corn Growers Association, the National Farmer Union, the Nebraska Corn Growers Association, the Nebraska Farm Bureau Federation, the Renewable Fuels Association, and Renewable Fuels Nebraska.

U.S. Sens. Tammy Baldwin (D-WI), Shelley Moore Capito (R-WV), Tammy Duckworth (D-IL), Dick Durbin (D. IL), Joni Ernst (R-IA), Chuck Grassley (R-IA), Amy Klobuchar (D-MN), Roger Marshall (R-KS), Jerry Moran (R-KS), Pete Ricketts (R-NE), Mike Rounds (R-SD), Tina Smith (D-MN), and John Thune (R-SD) cosponsored the bill.

“For our country to remain a global energy leader, we must continue to invest in renewable and clean energy so we can decrease our emissions and dependence on foreign oil,” Sen. Duckworth said. “Producing less expensive fuel choices like E15 that can be sold year-round would help lower gas prices, protect the environment, support our farmers and drive economic opportunity throughout the Midwest.”

U.S. Reps. Angie Craig (D-MN) and Adrian Smith (R-NE) introduced a companion bill in the House of Representatives.

Last month, on the first day of his term, President Trump took steps to make E15 available year-round through his Executive Order Declaring a National Energy Emergency.
